Joe got fired today. The employer gave him no notice and no explanation - they said that they didn't have to give him either based on the contract he was under. This contract was part of the "WorkChoices" scheme, which essentially stripped employees of most of their rights while masquerading as a better and more flexible system than the previous Award system that ensured employee rights. WorkChoices was introduced by our previous government, the Liberals / Australia's right-wing party.

Since Labor (the corresponding left-wing government, though both parties are increasingly meeting in the middle) got back in, they've introduced something called the No-Disadvantage Test. Each WorkChoices contract must be sent in and scrutinised under this test to ensure that it doesn't put workers at disadvantage compared to the Award agreement they'd have received pre-"reform".

When Joe got home from being fired today, he received a letter from the government stating that the contract he was under did NOT pass the No-Disadvantage Test.

I suspect these two events may be related.

So in short, they've had him working for months under a contract that was so ridiculously unfair it cannot be considered legal, and when they were finally called on it, rather than fix it up, they fired him.

By the way, I'm going to name-and-shame on this one: it was Pisces Enterprises. Pisces Enterprises, Pisces Enterprises, Pisces Enterprises. If I type it enough, perhaps it'll come up on page 1 in Google searches for their company. People should know about this sort of behaviour.

And my mother wonders/shakes her head over why my generation has no company loyalty themselves. Um...maybe because of shit like this?

I don't understand whatever happened to the 'common human decency' clause we're should have been raised by.

damn - same thing's happening over here (half of the office has been made redundant or moved to a lower paid position).

You'd better watch it, or Pisces Enterprises will sue you for defamation next. It sounds like a very unethical company that Joe's better off out of, though of course he won't think so right now. I wonder if they'll come after everyone that comments as well? Some companies seem to have no discernible business plan except to sue the hell out of everyone else.

This is indeed the suck.

Unfortunatley over the coming months you can expect to see a lot more of this. People asked to do more with less, for less and employers using the fear of unemployment to drive even harder bargains than before.

The No-Disadvantage test is still very heavily in favour of the employer is very unlikely to change any time soon. It does have the disadvantage that part of the procedure is they contact the employer and disclose the identity of the person making the request - giving the employer the easy out as they have done in this case of letting the person go (legally) under the original contract before they can be ruled against.

I have no idea what work he might be looking for but certainly UQ has a few positions open at present

Seems to be rampant these days, businesses making bad decisions then firing people who had nothing to do with it to try and save their asses. So sorry, guys, that really blows.
